DECISIONS CONCERNING ENTREPRENEURS
1. General provisions.
1.1. The available online shop under the www.przyjazne-ukulele.pl Internet address is run by GNIEWOMIRA SKRZYSIŃSKIEGO of person in charge of the business activity under the name the online shop Przyjazne Ukulele "Friendly Ukulele" GNIEWOMIR SKRZYSIŃSKI (the address of the place of business and the address for correspondence: Krasna 57, 38-420 Korczyna) written down in the Central Register and Information about the business activity of the Republic of Poland led by the competent minister for economies, VAT EU: PL6881251916, REGON 180664192, e-mail address: email@example.com.
1.2. This Regulations are directed both to consumers, and to entrepreneurs using the online shop (except for pt 10 of Regulations which is directed exclusively at entrepreneurs). Provisions of this Regulations aren't aimed turning off or limiting any consumer rights it being entitled to them on the legal validity of absolutely binding provisions of the law - all possible doubts are being explained to the benefit of the consumer. In case of the incompatibility of provisions of this Regulations with above regulations, regulations have supremacy.
Working days - one day on weekdays with excluding days by law off.
Form of the Registration - available form in the online shop enabling to create the Account.
Order form - interactive available form in the online shop enabling to place an order.
Customer - Client which is going to enter into or entered into contract of sale with the Seller.
Civil code - act civil code from 23 April 1964 (Journal of Laws No. 16, as amended pos. 93).
Account - marked with individual name (with login name) and with password given by the Client set of stores in the teleinformatic system of the Contractor, in which data is being collected for the Client including information about placed Orders.
Newsletter - distribution electronic services provided by the Contractor via the email e-mail which enables automatic receiving next contents for Clients for everyone using it of edition of the newsletter containing information about novelties and Products in the online shop.
Product - available in the online shop chattel being a subject of the contract of sale between the Customer and the Seller.
Regulations - this regulations of the online shop.
Online shop - the online shop accessible to the Contractor under the Internet address: www.przyjazne-ukulele.pl.
Seller; Contractor - GNIEWOMIR SKRZYSIŃSKI person in charge of the business activity under the name the online shop "Friendly Ukulele" GNIEWOMIR SKRZYSIŃSKI (the address of the place of business and the address for correspondence: Krasna 57, 38-420 Korczyna) written down to the Central Register and Information about the business activity of the Republic of Poland led by the competent minister for economies, NIP 6881251916, REGON 180664192, e-mail address: firstname.lastname@example.org. in case of electronic services the Newsletter is a contractor: Piotr MAJEWSKI person in charge of the business activity under the MAJEWSKI name Business Consultancy Piotr MAJEWSKI (the address of the conduct of business and the address to doręczęń: ul. Łańcucka 12 and/ 8 80-809 Gdańsk) NIP: 585-139-26-23.
Contract of sale - Agreement of the sale of the product entered into between the Customer, but the Seller via the online shop.
Electronic services - service provided via e-mail by the Contractor for the Client via online services.
Client - natural person having a full capacity to act in law, and in accidents expected by generally applicable provisions also natural person having a limited capacity for acts in law; the legal person or the without organizational unit of the legal personality which the act is granting the legal capacity using electronic services.
Order - declaration of intent of the Customer Agreements aiming directly at the conclusion of the sale of the product with the Seller.
2. Kinds and the scope of electronic services
2.1. The contractor is providing the following electronic services via the online shop:
The lead of the Account in the online shop.
Enabling to place an order in the online shop through the filling of an order form.
3. Conditions of proving and entering into an agreement for providing electronic services
Providing electronic services by the Contractor is unpaid.
3.2. Period to which the agreement is being entered into:
The providing electronic services consisting in leading the Account agreement is contained in the online shop for the indeterminate time.
The benefit agreement of electronic services consisting in enabling to place an order in the online shop through the filling of an order form she is contained for the fixed time and is undergoing solving upon placing an order.
Providing electronic services agreement Newsletter is contained for the indeterminate time.
3.3. Essential specifications for the cooperation with the teleinformatic system which the Contractor is using:
The computer, the laptop computer or other multimedia device with the access to the Internet.
Access to the electronic mail.
Web browser: Mozilla Firefox in the version 11.0 and higher or Internet Explorer in the version 7.0 and higher, Opera in the version 7.0 and higher, Google Lame in the version 12.0.0 and higher.
Recommended width of the screen: 1024x768.
3.4. The obliged client is for using the online shop in the way lawful and with good manners bearing in mind respect of personal rights and laws for the intellectual property of third parties.
3.5. The obliged client is matching the actual state of affairs for the data capture.
3.6. A ban on the content delivery is applying to the client about unlawful character.

4. Conditions of containing the contract of sale
4.1. Announcements, advertisements, price lists and other product information given on websites of the online shop, in particular their descriptions, technical parameters and functional and prices, constitute inviting for the conclusion of a contract, as defined in the Art. 71 of civil code.
4.2. Price of the product shown on the side of online shop is given in zlotys Polish and contains all ingredients, including the value added tax and the customs. However prices don't contain possible delivery charges and payments which are being appointed in the course of placing an order.
4.3. Price of the product shown on the side of online shop is binding in the moment of placing an order by the Customer. This price won't change irrespective of changes in prices in the online shop which can appear with reference to individual Products after placing an order by the Customer.
4.4. Entering the Agreement of the Selling into with the Form of Orders
In order to enter into an agreement earlier folding by the Customer an order is essential for the Sale.
After placing an order the Seller immediately is confirming receiving it what tying of the Customer it causes with Order as well as simultaneously is accepting an order for the accomplishment. Confirming receiving an order and his admitting to implementations are taking place by sending the appropriate message to the e-mail address of the Customer which contains at least confirming all crucial elements of the Order, statements of the Seller about receiving an order and about his admitting to the accomplishment.
With the moment of receiving by the Customer the message e-mail which is being talked about in the 4.4.2 pt. an included contract of sale is staying between the Customer, but the Seller.
4.5. Every contract of sale will be confirmed with receipt of purchase.
5. Manners of payment
5.1. The seller is making the following manners available to the payment:
Payment cash on delivery at the receipt of the parcel.
Payment by the traditional transfer to the bank account for Seller.

5.2. Is providing the handling of electronic payments as the accounting agent:

6. The cost, the date and manners of the delivery
6.1. The seller is making the following manners of the delivery of the Product available:
Courier DPD parcel;
Personal receipt at the address: Krasna 57, 38-420 Korczyna, in working days in 10:00-18:00 hours.
6.2. Possible delivery charges are shown in the course of placing an order. They are dependent on the manner chosen by the Customer of the delivery and the payment. Delivery charges are also on the side shown of online shop in the bookmark "delivery charges".
7. Conditions of solving Electronic providing services agreement
7.1. The contractor and the Client can dissolve a contract for providing electronic services at all times by way of the mutual agreement of the parties.
7.2. Saying the Electronic providing services agreement:
An indefinite providing electronic services agreement can surrender to notice about constant character (e.g. leading the Account in the online shop).
The client can terminate an agreement without showing causes by sending the appropriate statement in particular via the electronic mail to the address: email@example.com or in writing to the address: Krasna 57, 38-420 Korczyna. The agreement in such case expires after the end of 14 days for the day of filing the declaration of intent about giving her notice (notice period).
In case of Clients being consumers simultaneously the Contractor can terminate an agreement for providing indefinite electronic services about constant character in the event that the Client objectively grossly or stubbornly is contravening Regulations, in particular when is delivering to contents about unlawful character, after the fruitless to say the least single call to cease or to remove infringements with setting the right date. Infringing the regulations must have objective and unlawful character. The agreement in such case expires after the end of 7 days for the day of filing the declaration of intent about giving her notice (notice period).
In case of Clients not being consumers simultaneously the Contractor can terminate an agreement for providing indefinite electronic services about constant character with immediate effect and without pointing of causes by sending the appropriate statement via the electronic mail or in writing to the address for the Client indicated in frames of the account.
8. Course of action complaints
8.1. Customer complaints on account of the variance of the Product with the contract of sale:
The base and the area of responsibility of the Seller towards the Customer being a natural person which is purchasing the Product to the purpose unrelated to the occupational activity or economic, on account of the variance of the Product with the contract of sale are determined in particular with act about specific conditions of the consumer sale and about the amendment to the civil code from 27 July 2002 (Journal of Laws No. 141, as amended pos. 1176).
It is possible to make the notice about the variance of the Product with the contract of sale and submitting a right request in particular via the email to the address: firstname.lastname@example.org or in writing to the address: Krasna 57, 38-420 Korczyna. When it is possible and essential for the evaluation of the variance of the Product with the agreement one should provide with him to the address: Krasna 57, 38-420 Korczyna.
The seller will take a stance for demanding the Customer immediately, not later than within 14 days. The reply on the customer complaint is being sent to the address given by the Customer or in other way given by the Customer.
In case of included also Products with guarantee the Seller is announcing that the warranty on sold consumer goods isn't turning off, isn't limiting or isn't hanging entitlements of the purchaser resulting from the variance of goods with the agreement.
8.2. Customer complaints associated with providing electronic services by the Contractor and other customer complaints associated with action of the online shop:
Customer complaints associated with providing electronic services via the online shop and other customer complaints associated with action of the online shop the Client can fold in particular via the email to the address: email@example.com or in writing to the address: Krasna 57, 38-420 Korczyna.
They are recommending giving as the most information and circumstances of the customer complaints concerning the object, in particular the kind and the date of the address to the irregularity and of the contact information - he will facilitate it and considering the customer complaint by the Contractor will speed up.
Considering the customer complaint by the Contractor is taking place immediately, not later than within 14 days.
The reply on the customer complaint is being sent to the Contractor to the e-mail address given to the Client in the complaints application or in other way given by the Client.
9. Law of the withdrawal from the agreement
9.1. Client (Customer) being a consumer which entered into an agreement from a distance, perhaps from it simultaneously to give without stating causes, filing the appropriate statement in writing within ten days. For keeping this date sending declaring before his expiry will be enough. It is possible to send the statement in particular via the email to the address: firstname.lastname@example.org or in writing to the address: Krasna 57, 38-420 Korczyna.
9.2. The demonstration form template of the withdrawal from the agreement entered into from a distance constitutes the enclosure of No. 1 to Regulations.
9.3. In time of the withdrawal from the agreement the agreement is regarded nonincluded, and the consumer is dismissed from all obligations. What sides provided, is undergoing the return in the unchanged state, unless the change was necessary within the limits of the ordinary management board. The return should take place immediately, not later than within fourteen days. If the consumer made any advance payments, from them statutory interest on the date of making an advance payment will lie for a long time.
9.4. Contractor (Seller) will make the return to the number indicated by the consumer of the bank account or in other way shown by the consumer.
9.5. The date ten days long, in which the consumer can withdraw from an agreement, is calculated from a day of giving the Product, and when the agreement is regarding providing electronic services for the day of for her entering into.
9.6. From a distance a consumer isn't entitled to a right to withdraw from the agreement entered into in accidents: (1) of service delivery begun, with the consent of the consumer, prior to the deadline, above-mentioned into the 9.1 pt and 9.5; (2) of concerning recordings audialnych and visual and recorded on computer data carriers after removing by the consumer their original packaging; (3) of agreements concerning benefits, for which the price or the remuneration depend exclusively on the fluctuations in prices on the financial market; (4) of benefits about properties determined by the consumer in the order placed by him or closely tied with his person; (5) of benefits which due to their character cannot be returned or of which the object is undergoing the fast corruption; (6) of delivering the press; (7) of services in gambling games.
10. Final provisions
10.1. Agreements entered into through the online shop are being entered into according to the Polish law and in Polish.
10.2. Amendment to the rules of procedure:
The contractor is reserving the right to cause amendments to the rules of procedure from important reasons i.e.: the amendment to provisions of the law; changes of manners of payment and supplies; changes of the scope, the payment or the form of provided electronic services, changes of address of the Seller - in the scope, in which these changes influence implementations of provisions of this Regulations.
Amended regulations are binding the Client, if preserved determined requirements stayed in Art. 384 of civil code, i.e. the Client correctly was notified of changes and the Client didn't terminate the Electronic providing services agreement about constant character within 14 days of the day of the notification.
However amendments to the rules of procedure in no way will be violating vested interests of Clients being consumers simultaneously and using the online shop before the effective date of changes, in particular amendments to the rules of procedure won't be affecting already placed Orders, entered into or made contracts of sale.
In an accident if the amendment to the rules of procedure resulted introducing any new fees or increasing those present the Client being a consumer has a right of the withdrawal from the agreement.
10.3.W unsettled matters provisions are applicable to this Regulations: of civil code; Acts on the service delivery with electronic means from 18 July 2002 (Journal of Laws No. 144, as amended pos. 1204); Acts about the protection of some consumer rights and about the responsibility for the damage caused by the dangerous product from 2 March 2000 (Journal of Laws No. 22, as amended pos. 271); Acts about specific conditions of the consumer sale and about the amendment to the civil code from 27 July 2002 (Journal of Laws No. 141, as amended pos. 1176) and other appropriate provisions of the Polish law.
10.4. Settlement of disputes:
Disputes incurred between the Seller/contractor, but the Customer/client being a consumer simultaneously are being possible surrendered to competent courts of general jurisdiction.
Disputes incurred between the Seller/contractor, but the Customer/client not being the consumer simultaneously are being possible surrendered to the competent court on account of the registered office of the Seller/contractor.
